Repression of Media Freedom and Civil Society in Georgia

The anti-democratic actions initiated and implemented by the “Georgian Dream” party mirror the repressive methods of the Soviet Union and today’s Russia. These measures are aimed at establishing authoritarian rule.

The Case of Mzia Amaghlobeli – A Symbol of the Repressive System

The unlawful imprisonment of Mzia Amaghlobeli, founder of Batumelebi and Netgazeti, clearly manifests “Georgian Dream’s” repressive character. The severe deterioration of Amaghlobeli’s health, particularly her vision, clearly indicates the negative impact of her unlawful imprisonment.

A resolution adopted by the European Parliament with 324 votes, which calls for the release of Mzia Amaghlobeli and other political prisoners, confirms that the international community recognizes the political nature of the ongoing repressions in Georgia.

The “Abolition” of Freedom of Speech Legislation

The proposed amendments to the “Law on Freedom of Speech and Expression” represent a continued attack on freedom of expression. These changes would establish a legal framework that effectively dismantles media, encourages journalists into self-censorship, and ultimately destroys critical public discourse.

Specifically:

  • The clause that places the burden of proof on those initiating restrictions of free speech would be abolished.
  • The principle that any unresolved doubt must be decided in favor of free speech would be removed.
  • The provision that prohibits a court from ruling against a respondent simply because they refuse to disclose a professional secret or source would also be eliminated.
  • Content-based regulation of speech and expression would be introduced, covering both face-to-face and public insults.

These changes-such as the effective removal of the right to protect sources, would mean the end of investigative journalism. It would become impossible to report on matters of significant public interest. Content-based regulation opens the door to broad interpretation and could be used to silence any critical voice, placing every citizen at risk of legal liability.

A New Draft Law Destroys Transparency of the Judiciary

A new bill fast-tracked by “Georgian Dream” concerns media coverage of court proceedings. The proposed law would prohibit the media from recording court processes, depriving the public of the opportunity to monitor how the justice system functions.

The bill includes:

  • A ban on filming in courtyards and corridors.
  • Exclusive authority for video recording proceedings is granted only to the court or authorized individuals.
  • Audio or video recording of sessions is allowed only through a justified motion and a judge’s motivated decision.
  • The court would have the right to confiscate personal items, including mobile phones, computers, and any photo, film, video, or audio devices.

These changes critically restrict media activity and effectively eliminate public oversight of the judicial system.

Coordinated Attacks Against Civil Society Organizations

The Anti-Corruption Bureau’s actions against civil society-including member organizations of the Media Advocacy Coalition, such as Transparency International Georgia, Media Development Foundation, Civil Society Foundation, and ISFED, constitute a coordinated attack on civil society.

The illegal demand for personal data of beneficiaries, legal confidentiality, and full details of organizational activities violates not only the rights of the organizations but also the constitutional rights of thousands of citizens. These actions aim to limit the rights of beneficiaries, intimidate civil society, halt its activities, and ultimately dismantle democratic institutions.

The Media Advocacy Coalition expresses full solidarity with its member organizations. We also support our partner organizations and colleagues in their legal struggle and firmly believe that these repressive actions will not stop civil society’s work. Our organizations will utilize every available legal mechanism to protect their rights and dignity.

At this critical moment, the Media Advocacy Coalition calls on all democratic forces in Georgia-media organizations, civil society representatives, and every citizen-to unite in support of media and civil society. The protection of media freedom and civil society is the foundation of democratic liberty.

We call on international partners, organizations, and democratic countries to strengthen their attention to the ongoing developments in Georgia and to support democratic forces in the country.
